Villa Kolibri Terms & Conditions

  1. Booking Terms and Conditions
    By Accepting these Terms and Conditions, I (“Renter”) agree that the following terms, conditions and rules apply to this short-term rental of Villa Kolibri, from the owners’ authorised representative Mark Donnelly (“Owner”).
    These terms are deemed accepted by you and others on the booking, upon payment of the deposit, or full payment, whichever is earlier.
  2. Property
    This agreement is a short-term rental agreement for Villa Kolibri (the “property”) – (gps: 35.461337, 24.233018) near the village of Kokkino Chorio, Apokoronas, Crete, Greece. A 4 bedroom villa with private pool and jacuzzi.
  3. Term
    The short-term rental lease shall begin on the arrival date shown in my booking confirmation, and ends on the departure date shown in the booking confirmation. The property will be ready for occupancy no earlier than 15:00 on the arrival date and must be vacated no later than 10:00 on the departure date.  
  4. Rent: The rent is as per my booking confirmation, and payable as follows: 
  5. Payments:
    A 10% deposit of the rental fee, is required on confirmation of the booking, to secure and reserve the Villa.
    A further 40% deposit of the rental fee, is required 60 days prior to check-in. If the booking is made 60 days or less to the check-in date, a 50% deposit is required.  
    The remaining balance, including damage deposit, additional services and taxes will be due 30 days prior to check-in at the villa.
  6. Included in the rental fee:
    The villa is let fully furnished and equipped. Fresh linen, towels, internet, water and electricity are included.
  7. Cancellation and amendments policy
    If the Renter wishes to amend the booking they will notify the Owner by email. The owner will try and accommodate the requested change, but it may not always be possible. 
    If The Renter wishes to cancel the booking, they will notify the Owner by email. Cancellation takes effect from the date this correspondence is received. 
  8. Cancellation refunds:
    If Cancellation is within 48hrs of booking, and more than 30 days before check-in, the Renter will receive a full refund of payments made.
    If Cancellation is made at least 30 days before check-in, the Renter will receive a full refund of payments made, less a 250.00euro processing charge.
    If Cancellation is made between 30 – 7 days before check-in, the Renter will pay 50% of the full rental due.
    If Cancellation is made less than 7 days before check-in, the Renter will pay 100% of the full rental due.
  9. Maximum Occupancy:
    Occupancy is limited to a maximum of 8 persons (including children).  If the Owner concludes that this policy has been breached, the Owner reserves the right to expel the entire party with no refund. 
  10. No Subletting: Renter may not sublet or assign this lease for all or any part of the premises without prior written consent of the Owner. 
  11. Use of Property
    • The Renter is responsible for compliance with any and all laws, rules, and regulations that may apply to their use of the Property during your stay, including, without limitation, as may apply to the residence, grounds, pools, appliances, and equipment. I acknowledge and agree, and will procure that any individuals whom I invite (or otherwise provide access) to the Property acknowledge and agree, to the following requirements:
      • The Renter will ensure that the Property and all furniture, fixtures, and effects remain in the condition and location as when you arrived. You will also follow any house manuals the Owner may present to you at the Property.
      • The Renter agrees to pay Owner for any damages to furnishings, household items, pool or jacuzzi, that occur as a result of Renter’s occupancy. This will include payment of any additional cleaning charges over 100.00 euro, incurred due to Renter’s occupancy.
      • The Renter cannot carry out any illegal activity at the Property, or any activity that could be reasonably considered a nuisance to the Owner or the occupants of neighbouring land.
      • Any use of pool (which has a depth of 1.5m), jacuzzi, equipment, fire-pits, and/or any other features of the Property are entirely at the Renter’s and their guests’ own risk. You acknowledge that children and all non-swimmers should be supervised at all times.
      • The Renter must be at least 25 years of age. By making this booking, you represent and warrant that you meet this age requirement.
      • Events, parties and similar events are not allowed
      • Pets are not allowed
      • Commercial photography and filming are not allowed
      • The check-in time is after 15:00, and the check-out time is by 10:00
      • It is prohibited to smoke or vape inside the villa. If smoking outside, be aware of the dangers of vegetation and scrub fires, as a fire can incur penalties and charges which will be the responsibility of the Renter
      • Between 10 PM and 8 AM, please respect the neighbours and reduce the volume of your noise if it might disturb them. 
  12. Security/Damage refundable Deposit
    Your Final payment will include an additional 500 Euro damage deposit, which will be refunded to the Renter’s Payment Method 5-7 days after check-out, subject to no damage claims being identified.
  13. Access
    The Renter shall allow Owner or their authorised representative access to the property for purposes of repair, inspection or emergency. The Owner or their authorised representative, shall exercise this right of access in a reasonable manner.
  14. Owner’s Rights:
    Renter agrees that if the conditions and limitations set forth herein are not met, Owner shall have the right to cancel this agreement and may enter the Property, either by statutory proceedings or by force, to inspect the Property and ensure that Renter has vacated the Property. All monies paid by Renter shall be forfeited as liquidated damages. Any reasonable costs incurred by the Owner in enforcing these terms and conditions can be recovered from the Renter.
  15. Owner’s Liability and Indemnity Clause.
    The Owner’s liability for personal injury or property damage arising from the use of premises or the items of personal property provided therein, is indemnified and held harmless by Renter and Renters’ Guests, regardless of the nature of the injury or damage. Renter assumes all risk of injury or other losses relating to any recreational activities including use of the private swimming pool and jacuzzi on the Property and will hold the Owner harmless with respect thereto.
    The Renter explicitly acknowledges that any insurance the Owner maintains does not cover their personal property, so they should ensure their personal items are covered by their own insurance. 
  16. Legal and Binding Agreement. 
    As stated above, this agreement is legal and binding between the Parties. The Parties each represent that they have the authority to enter into this Agreement.
  17. Governing Law. 
    This contract is governed by Greek law.
  18. Water and electricity cuts.
    During the busy summer months, with maximum visitor numbers the local water and power grids are under pressure. This may result in delays or faults in the supply networks and there can be cuts while essential maintenance work takes place. The Owner cannot be held responsible for such occurrences and inconveniences.
  19. Force Majeure.
    The Owner cannot accept liability where the performance of our contractual obligations is prevented or affected by ’force majeure’. In these terms and conditions of rental ‘force majeure’ means any event which we or the suppliers of the service(s) in question could not, even with due care, avoid. Such events may include but are not limited to war, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorist activities, quarantine, epidemics, weather conditions, construction in the area by third parties, government action, or other events outside our control.
